Terms of Service

By accessing or using QuestWink, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. We may update these Terms from time to time, and your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

QuestWink helps parents and guardians create custom, AI-generated treasure-hunt adventures for the children in their lives. Each quest is a themed, multi-stage experience with an original story and artwork, opened with a single QR code or link. New accounts may receive their first quest free, and additional quests may be unlocked through gift codes or other offers we make available from time to time.

You must be at least 18 years old and able to form a binding contract to create a QuestWink account. QuestWink is designed to be set up and managed by an adult parent or guardian on behalf of a child. As the account holder, you are responsible for any quest you create, for printing and distributing clues safely, and for supervising children during play. You agree that any information you provide about a child is provided by you as that child's parent or legal guardian, or with that guardian's permission.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Gift codes and promotional credits have no cash value, cannot be exchanged for money, and may expire or be subject to additional conditions. We may suspend or invalidate codes that we reasonably believe were obtained or used improperly.

You agree not to use the Service to:

• violate any applicable law or the rights of others, including intellectual-property and privacy rights;
• create content that is unlawful, harmful, harassing, hateful, sexually explicit, or otherwise inappropriate, particularly given the Service's child-focused nature;
• attempt to disrupt, reverse engineer, scrape, or gain unauthorized access to the Service or its underlying systems; or
• impersonate any person or misrepresent your affiliation with any person or entity.

The Service, including its software, branding, and design, is owned by QuestWink and protected by intellectual-property laws. Quest stories, artwork, and other content generated for you may be used by you for personal, non-commercial purposes such as playing the quest with your child. You may not resell or commercially redistribute generated content without our written permission. We may use de-identified or aggregated information about quests to operate and improve the Service.

Quest content is produced using artificial-intelligence models. While we strive for quality and age-appropriateness, AI-generated stories and images may occasionally contain inaccuracies, unexpected results, or content that may not suit every child. We encourage you to review each quest before sharing it with a child. QuestWink does not guarantee that generated content will be error-free or fit for any particular purpose.

Some features may require payment or the redemption of a gift code. Prices and offers are described at the point of purchase and may change. Except where required by law, payments are non-refundable once a quest has been generated, since generation consumes computing resources at the time of your request. If you believe you were charged in error, contact us and we will work with you in good faith.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

To the maximum extent permitted by law, QuestWink and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid to us for the Service in the twelve months before the claim arose.

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination - such as intellectual-property, disclaimer, and limitation-of-liability terms - will survive.

We may revise these Terms from time to time. When we do, we will update the "Last updated" date above. Material changes will be communicated where appropriate. Your continued use of the Service after changes take effect means you accept the updated Terms.
